New Jersey Adult Protective Services Lawyers
Adult Protective Services investigates allegations that a vulnerable adult is being or has been the subject of abuse, neglect or exploitation. While many APS cases involve the elderly, vulnerable adults include anyone that is at least 18 and has a physical or mental illness or disability makes it difficult for them to make or communicate decision regarding their well-being. When they get a referral, they must investigate it within 72 hours. APS can also petition the court for temporary and permanent relief.
Some examples of APS cases include adults that can no longer care for themselves, adults that are being physically and mentally abused by others and those that have money and assets being taken from them. One common fact pattern is a bank that calls APS because an elderly person is at a local branch attempting to withdraw a large sum of money while being accompanied by someone else.
Regardless of the allegations, Adult Protective Services cases can lead to criminal charges such as assault, forgery and theft. Anything you do or say can be used against you. That's why we always suggest that you speak to a defense attorney before you do or say anything. If you are involved in a APS investigation, call us right away to protect your rights.
